I'm sorry for your loss. 1st, consult a lawyer specialising in medical negligence & he'll fill u in. i am not a lawyer. in order for the hospital to be guilty of negligence:

a) u must be able to answer how what exactly the hospital shouldve done to prevent your ma's death. sure, the nurse couldve check on your mum more often, but if she did, what could she have done that would save ur ma's life (cpr, medicine etc)? was she so terminally ill that there was nothing the hospital couldve done that wouldve saved her life?

b) u must also show that the hospital's action/ inaction CAUSED your ma's death (ie u must be able to say: "BUT FOR the nurse's failure to check on my ma more often than 2 hrs & give her xyz medicine, she wouldnt have died")

c) u must also show that the hospital staff failed to act in a manner "reasonable" according to people of the same profession qualified in the country you're pressing charges in. in court people of the same profession will give evidence on how they wouldve reacted in the same situation.
even if the nurse's failure to check on ur mum led to her death, if all other nurses giving evidence agree that they wouldve done the same thing, the hospital is unlikely to be held guilty of negligence. there are rare occassions where courts go against the evidence from the medical professionals, but that's only in circumstances where the med opinion is totally ludicris.

but they did not hook her up to any heart monitors or any other devices to monitor her vitals.

THAT IS HOW REGULAR ROOMS WORK. THE ROOMS WITH ALL THE MONITORS ARE CALLED "ICU" ROOMS.

At Midnight (Thursday morning) she was complaining of some pain and the nurse did not give her any pain meds, becuase she had 1 1/2 an hour to get some more pain med.

DOCTORS ORDER THE MEDICATIONS, GIVE THE DRUG, AMOUNT, ROUTE AND RATE OF ADMINISTRATION. IF THE NURSE GIVES THE MEDICATION FASTER THAN ORDERED, SHE IS NOT FOLLOWING ORDERS AND CAN LOSE HER LICENSE. THE NURSE DID WHAT SHE WAS SUPPOSE TO DO.

The nurse noticed that she was having difficulty breathing so he ordered a respitory Therapist to give her a breathing treatment,

THE NURSE NOTICED YOUR MOTHER WAS HAVING A BREATHING PROBLEM SO CALLED RT TO DO A TREATMENT THAT WAS PROBABLY ORDERED BY THE DOCTOR. (NURSES CAN NOT ORDER TREATMENTS, DOCTORS DO THAT.)

at 12:15 the therapist started the treatment, and my mother was left alone

THE RT DID THE TREATMENT AND HE MUST HAVE FELT YOUR MOTHER RESPONDED PROPERLY SO HE LEFT. IF YOUR MOTHER WAS NOT DOING OK, HE WOULD NOT HAVE LEFT. HE CERTAINLY WOULD HAVE TOLD THE NURSE YOUR MOTHER WAS NOT DOING OK,.

the nurse did not check on her for 2 hours, and a little after 2 am he walked into the room and she was gone.

PEOPLE DIE IN HOSPITALS EVEN WITH THE BEST OF CARE. YOUR MOTHER WAS IN A REGULAR ROOM, AND THE NURSING STAFF GENERALLY DOES NOT CHECK ON THE PATIENTS MORE OFTEN THAN EVERY TWO HOURS UNLESS MORE FREQUENT CHECKS ARE ORDERED.

Now is there any negligence there, or do you think that I am just overacting?

FROM WHAT YOU WROTE, YOU ARE GRIEVING AND ARE AT THE STAGE WHERE YOU ARE LOOKING FOR FAULT. IT DOES NOT SEEM TO ME ANYONE DID ANYTHING WRONG.

HERE ARE SOME QUESTIONS TO ASK YOURSELF.

DID MOM SMOKE A LOT AND FOR MANY YEARS? If she did, a lot of her lung problems were caused from smoking and not the care she was given..

DID YOUR MOM GET THE FLU SHOT THIS YEAR? If she is elderly and/or has a history of lung problem and/or smokes, she should have gotten it early in the year.

DID YOUR MOM HAVE OTHER HEALTH PROBLEMS? Was she way over weight? Was she a poorly controlled diabetic? Why was her BP so high? Did she have high blood pressure and not take her meds?

HOW OLD WAS YOUR MOTHER? No one can live forever and if she was really old, it may have just been her time.

Sorry about your loss but try to deal with it. Grieving is hard to handle and perhaps you need to talk to someone about it.

actually no. i know it sucks but it sounds like the hospital did everything in regulation.. why were you not there?
