You might want to consider also how your daughter approaches these situations. Teenagers often have less than polite attitudes--and those attitudes can escalate situations. If she's asked to clean up something, she might be reacting in a way that asks for trouble and the people in authority may see it as a typical teen trying to get out of trouble. (Remember, most people, especially an administrator or a police officer, won't know about her 504 plan unless they go and look it up. They can't be expected to remember her exact special needs when they are dealing with masses of students in the cafeteria.)

She may need to respond by calmly (and politely) responding that she can't do that due to a medical condition documented on her 504 plan and perhaps suggest something else that she could do instead--that way it won't seem like she's just trying to get out of doing her part to keep things clean or that she's just using a 504 plan to show up the people in charge.

But I'd also look into a lawyer under ADA. Or into switching schools. Or both.
Also see if she can get a copy of the 504 plan to keep in order to have it handy to show people in authority when needed.

I would go in and have a sit down with the principal(s) and most likely bring your daughter as well. Get their side of the story so you will know both parts. As calmly as possible, explain your daughter's situation just so you can say that you have made every attempt to educate them on the subject. Then, go to the school board about this issue. You will be prepared to share both sides of the story AND you will look like you have taken every measure to solve the problem without their help.

If the school board refusese to give you the help you desire, I would contact the newspaper and/or local news about the issue. Lots of parents will want to know that this type of treatment is going on in the school that their tax money is helping fund. Other parents will become concerned about the treatment of their children.

I would consider putting my child in a different school regardless of what happens.

Oh, and someone mentioned about tape recording what is going on. I would NOT recommend this, because a lot of schools have rules about bringing tape recorders inside their facilities. I say this because I have witnessed students at my school trying to catch teachers in something and record it in hopes of causing trouble, or increasing their grades. I don't know how well it would hold up in court either.

Just keep fighting.

Do you mean that they are saying your child has been harrassing someone, or that there are 2 incidents in which the school harrassed your child?

First of all, you need to write a letter to the principal and request to come in to the school and get ALL copies of your childs educational records. INcluding disclipline, attendance, report cards, etc. EVERYTHING.

And state that you will come in and look at all the original files your self and copy them there. If they say they will just give them to you without you first looking at the originals, just about everything will be 'missing'.

State in the letter that you have this right under FERPA law and the school has 45 days from the date of your request to let you have the copies.

All these files are very important in case they are lying to you, you'll have proof of everything, unless there are things they aren't documenting.

About throwing away students trash with her medical problem? I would tell your daughter to call you to come get her if they do this again.

AND, you need to file complaints with the ADA about all this. Write down EVERYTHING that has happened, what everyone did and said, times, dates etc and also copies of any documents that can prove your case. Send ALL this along with your ADA complaint.

It is discrimination to bully and disclipline a child BECAUSE of their medical, emotional, learning problems, etc.

I would also contact an attorney. A legal suit right in the bag.

have her carry around a tape recorder (small hand held) in her pocket.. get together a case.. have her tape when she is being harassed.. present your case to a lawyer.. i agree with the comment above.. sue. but you will need to prove your case.. not word of mouth.. but proof of mouth
