Because of the ADA (Americans with Disabilities Act) they can't refuse to hire him for a health problem that is unrelated to the job. For instance, if he's being considered for a job as a truck driver, they can't not hire him because of asthma. If he has fainting spells, well that's different. They are not even allowed to ASK about his health, except as it pertains to the job.

Think about it this way, would you want to be responsible for an individual, who while driving a county vechile kills someone because of an athsma attack? If the physical picked it up, they could deny him because it could cause an adverse situation for the company. But did they state that was the reason, or are you both jumping to conclusions, it could be they had others who better fit the bill and were healthier. When a company is hiring anyone who will be driving they want someone in the best health possible.

Nope. He may have insurance problems due to a pre-existing condition but if he can do the job safely and without any problems it is illegal to hire due to "health". Plus a person's health is their business. What's the job? It sounds suspicious.

Yes, they can deny him a job based on his health. Though having a cold isn't a problem for most companies.
